Terms and Conditions of service 

1. The main objective of the South African Broadcasting Corporation SOC Limited “SABC” is to supply broadcasting and information services to the public in the Republic of South Africa as set out in the Broadcasting Act No. 4 of 1999 as amended “Broadcasting Act”. 

2. The Terms and Conditions of Service contained herein as well as the Privacy Policy shall govern the relationship between us as the SABC and the User and/or Subscriber of our service/s. The User and/or Subscriber is only duly authorized to use the services or content if they agree to the Term and Conditions herein. 

3. It is the duty of the User and/or Subscriber to familiarize themselves with the Terms and Conditions of Service and the User and/or Subscriber shall be deemed to be bound by the Terms and Conditions as well as the Privacy Policy by using the services and content. Please be advised that we reserve the right to decide who registers for our services and are not obliged to furnish you with reasons as to why we have declined you access to our services. 

4. The User and/or Subscriber is only permitted to use the service for personal and non-commercial use. The User and /or Subscriber is duly granted a non-transferable and non-exclusive right to access our services and content. 

5. The use of our services must strictly be in accordance with all applicable laws of South Africa, and we prohibit any use of our Digital services or website/s and Mobile Application/s that is contrary thereto.

a. It is important to note that SABC uses YOUTUBE for playback through integration for some of their content and it is important that Users/Subscribers familiarize themselves with Google Privacy Policy and YOUTUBE Terms of Services 

6. We do not warrant nor guarantee the accuracy of the information on our Digital Platforms i.e. website/s and Mobile Application/s and hereby wish to advise the User and/or Subscriber that our services are rendered “as is” and we shall not be held liable for any inaccuracies or any losses of whatsoever nature. We encourage the User and/or Subscriber to take steps to verify all information before relying on it 

7. All personal information we acquire when a User and/or Subscriber when using our website shall be dealt with in accordance with the Protection of Personal Information Act No. 4 of 2013 “POPIA” as further detailed in our Privacy Policy. 

8. Any breach of these Terms and Conditions by the User and/or Subscriber shall be borne entirely by the User and/or Subscriber. We shall not be liable for any losses, damages or injuries caused by arising from the conduct of the User and/or Subscriber. 

9. All content or material on SABC Digital Platforms i.e. website/s and mobile application/s shall be and remains the exclusive property of the SABC, and the User and/or Subscriber agrees to comply 

with all legal formalities within the territory for the protection and preservation of the content and the SABC’s intellectual property rights therein. 

10. The User and/or Subscriber shall neither use nor permit the use, directly or indirectly, of the content for dubbing, copying and recording. 

11. All other rights in and to the content, including, without limitation, all copyright and other intellectual property rights relating to the programmes, are fully retained by the SABC. 

12. These Terms and Conditions shall be governed by the laws of Republic of South Africa and the User and/or Subscriber consents to the jurisdiction. 

13. Please be advised that these Terms and Conditions of Service are subject to change from time to time. 

Privacy Policy

1. This notice applies to the SABC’s Digital Platforms i.e., website/s and mobile application/s and all other media and communication platform services owned by the SABC. Please take time and acquaint yourself with this notice as it details how we process and protect your personal information that you share with us when you access all our Digital platforms and all media sites owned by the SABC. 

2. In terms of the Protection of Personal Information Act No.4 of 2013 “POPIA” the SABC is a Responsible Party for handling personal information belonging to its User and/or Subscribers known as Data Subjects. 

3. We are committed to protecting your privacy and the processing of personal information in compliance with POPIA that was enacted to give effect to a persons’ right to privacy through protecting individuals’ personal information from abuse such as identity theft in the Republic of South Africa. 

4. When you use our Digital Platforms and all other media and communication platform services, we will collect your personal information for internal process such as understanding who uses our platforms, where our audience is coming from geographically and more so as to be able to improve our services inclusive of content offering. We are legally obliged to safeguard all the personal information that we process in compliance with POPIA as guided by our Protection of Personal Information Policy. 

5. Under no circumstances will we share, rent or sell your personal information to a third party and we commit to use security measures to protect your personal information in our possession from abuse and only use such information for the purpose for which it is collected as well process data in accordance with POPIA. 

6. We require your consent prior to processing your personal information, however there are exceptional circumstances where we are permitted to disclose personal information if we believe that such action is necessary to:- 6.1 comply with a legal obligation; 

6.2 protect and defend the rights or property of the SABC; 

6.3 investigate possible wrongdoing in connection with the service; 

6.4 protect the personal safety of other users of the service or members of the public; and 

6.5 protect ourselves from legal liability. 

7. As a User and/or Subscriber, when you use our Digital platforms, we will collect the following personal information but not limited to the below; 7.1 general personal information including your contact details; 

7.2 usage information; 

7.3 device and browser information; and 

7.4 location and demographic information. 

7.5 User activities i.e., navigation and consumption of content and/or data on our digital platforms 

8. Please be further advised that some of our Digital platforms i.e. website use Cookies which you may opt to exclude by rejecting or by changing your privacy settings. Once a User and/or Subscriber accepts Cookies, SABC will have access to your digital footprint and will store this information and use it for information gathering purposes. 

Kindly note that from time to time we will have links to other 3rd party digital platforms i.e., websites and/or mobile applications on our website and all other media and communication platforms services owned by the SABC. Please note that once you click on the link, you will be redirected to a 3rd party platform i.e., website and will no longer on our website and all other media and communication platforms services owned by the SABC, this Privacy Policy will cease to be applicable and the notices on 3rd party platform i.e. website will be fully applicable. Q: WHY DOES THE RELIGIOUS PROGRAMME POLICY GIVE SPECIAL ATTENTION TO AFRICAN RELIGION?

A: Religious broadcasting should strive to be contextual and relevant, and to reflect our African reality. Towards further correction test of the neglect of African culture in the public media, special attention is given to African Religion and traditional cultures

Q: WHY DO WE NEED THESE CORE EDITORIAL VALUES?

A: The values, based on those articulated in the Constitution — including national development, unity, diversity, non-racialism, non-sexism, democracy and human dignity — represent those things that are commonly held by South Africans to be important.

Q: HOW IS AIRTIME FOR RELIGIOUS PROGRAMMING ALLOCATED?

A: In allocating air time to religious groups, the SABC is committed to the principle of fairness and applies this principle in determining the time allocated to each group. These allocations are made on a three-yearly basis, after consultation with the Religious Broadcasting Panel (RPB), taking the following into account: • Data on the percentage of the population in each religious group, as per the latest available census information. • The need for each of the major religions to enjoy meaningful and sufficient programming of a faith specific nature • The need for all the religions to be reflected in religious programmes • The need for sufficient programming of a multifaith nature • The need to redress past imbalances in religious broadcasting.

Q: DOES THE SABC’S EDUCATIONAL PROGRAMMING POLICY COMMIT TO FORMAL OR INFORMAL EDUCATION OR BOTH?

A: The SABC commits itself to providing innovative educational programmes of excellent quality across our radio and television services, aimed at meeting the diverse formal and informal learning needs of all our audiences, including children, youth and adults.

A: The SABC ensures that its educational programmes address imbalances in the historical provision of education, especially, but not exclusively, those based on race, gender and disability The SABC links its educational broadcasting to national priorities and needs, supporting the achievement of outcomes-based education, lifelong learning, and the association of educational and life experiences

Q: WHAT ARE THE THREE AREAS IN WHICH LOCAL CONTENT IS PRESCRIBED BY ICASA?

A: • Global local content quotas for each television channel. These stipulate that a percentage of the air time between 05:00 and 23:00 should be allocated to local content. The global quotas distinguish between public and commercial television • Genre quotas. These stipulate that if a television channel carries a certain genre of programming (such as drama), a percentage of that type of programming is to be allocated to local content. The genres are defined in the ICASA regulations3 and span the following six areas: drama, informal knowledge building, children’s, education, documentary and current affairs. In each case a minimum percentage is prescribed These quotas also distinguish between public and commercial television • Independent production quotas. Here the stipulation is that a percentage of the total amount of local content aired must be allocated to independent television productions. These quotas make no distinction between public and commercial services. All the quotas are set out in regulations which may be reviewed by ICASA every three years.

A: In determining allocation of time to each language, the SABC has due regard to: • The number of home language speakers in the coverage area of a channel • The geographical spread of the language • The extent to which members of a language community are able to understand other languages. • The extent of marginalisation of the language • The extent to which it is understood by other South Africans • Available resources.

SABC celebrates Heritage Month – #LiveYourHeritage

The South African Broadcasting Corporation (SABC) has lined up various activities in celebration of heritage month, which celebrates the nation’s diversity and calls on South Africans to unite despite their cultural differences.

5FM’s Nick Hamman of Hamman Time (Mondays-Fridays, 09:00 – 12:00) will take listeners on a true South African journey as he visits all nine provinces which started on the 1st of September.
The show will take its listeners on a month-long excursion as Nick Hamman and producer “Mad Money Mike” travel through the nine provinces, spending at least two days in each, as they learn more about the vibrant heritage in the cities and small towns.

Hamman Time will broadcast live every day of the tour and encourage listeners to promote their province by engaging with the show and sharing their stories. The tour is sure to deliver a unique experience as it takes a deeper look at the culture, history and sheer beauty South Africa has to offer. In conjunction with the live broadcasts, listeners can follow the tour on the station’s various social media platforms for interviews, video and images.

The Hamman Time Heritage Tour, which kicked off on 1 September and will move on to Limpopo, Mpumalanga, Gauteng, Kwa-Zulu Natal, Free State, Eastern Cape and Northern Cape before reaching the Western Cape just before Heritage Day. Be part of the journey by tuning in or following the @5FM and @HammanTime social media feeds using the hashtag #HammanTour and #LoveSA.
Radio 2000 will host an African Heritage Day event at the SABC offices in Auckland Park on Thursday, 21 September between 09:00 – 15:00.  The station has invited representatives from 27 African State Embassies to exhibit their rich African Cultural Heritage.

Phalaphala FM in partnership with Radzambo Cultural Foundation will be hosting a Phalaphala FM Traditional Dance Competition.  The traditional dance and music will feature the following categories:  Tshikona, Malende, Tshigombela, Visa, Kiba, Makgakgasi, Xigubu, Muchongolo and Xibelani covering the entire Vhembe District Municipality. The finals are preceded by the eliminations that are being held around the district a month prior September, with the finals being held during Heritage month.  Traditional dance competition finals will be held on the 30th September, at Rabali Stadium in Nzhelele within the Makhado Local Municipality.

Ukhozi FM will celebrate heritage month by partaking in two annual events that are the pinnacle of the Zulu nation cultural heritage celebrations. Umkhosi woMhlanga (Reed Dance) – Umkhosi woMhlanga is an annual Zulu ceremony that has become popular on the cultural tourism calendar and takes place at Enyokeni Royal Residence in Nongoma.

Umkhosi weLembe – Umkhosi weLembe celebrates the life and reign of Shaka kaSenzangakhona, King of the Zulus.  Last year (2016) marked 200 years since King Shaka founded the Zulu kingdom and 45 years since King Goodwill Zwelithini reigning King of the Zulu nation ascended to the throne. The celebration will takes place in kwaDukuza on the North Coast, where King Shaka was buried in 1828 at the age of 41.

Munghana Lonene FM is planning a Spring Shutdown to celebrate heritage month.  The shutdown will be hosted at the The Rest Lodge in Malamulele from 8 to 10 September.  Two shows will broadcast from the lodge on Friday 8 September followed by DJ’s mixes from 7pm till late.  On Saturday 9 September the station will host Xiseveseve and Makhwaya groups as well as local artists performances with a live recording of the station’s soapy Mina Hi Mina during performance breaks.  The weekend will close with a live jazz session which will have a picnic element of a bring and braai on Sunday 10 September.

• Shiviti Traditional Authority for Thomo Heritage & Culture Day on 22nd September

Lotus FM is planning to host its listeners and key stakeholders as part of heritage month. The event will celebrate the various rainbow cultures that South Africa is home to.  All guests will dress in their cultural attire and will indulge in traditional meals.  Lotus FM OAP’s and key members of management will be in attendance to interact with guest.  The event will also have key note speakers to address both attendees and the listeners tuning into the station.

trufm in partnership with the Steve Biko Centre, based in Ginsberg, Eastern Cape, will be celebrating Heritage Month and commemorating the 40 year anniversary of Steve Biko’s passing.  The Heritage Day celebrations will include dialogues, fashion, a traditional culinary experience while the Steve Biko anniversary will include a lecture. Both celebrations / commemorations will be hosted at the Steve Biko Centre.

RSG will cover a wide variety of topics, snippets and promo’s that focus on Heritage and Tourism during the month of September.  A special emphasis is placed on Farming and Sustainable Food Production in partnership with Syngenta, with daily crossings for discussions about Farming Technology and Excellence.  Various archive material will be packaged and broadcasted in celebration of Afrikaans historical heritage as well 80 years of Afrikaans radio in line with the stations birthday.

SABC Annual Report 2016/17

The South African Broadcasting Corporation (SABC) announced its annual results for the 2016/2017 financial year.

The SABC posted a net loss after tax of R977 million during the year under review. The organization experienced financial constraints owing to revenue streams deteriorating at a rate of 6% higher than the costs reduction. Cash and cash equivalents as at the end of 2016/17 financial year were R82 million compared to the previous year’s R881 million. This significant decrease in cash reserves has resulted in the SABC not being able to pay its debts as they fall due.

Revenue and other income for the period under review was R7.6 billion (2016: R8.1 billion) which is a 6% decrease year-on-year. Revenue is mainly derived from the primary revenue stream of advertising which decreased by 5% to R5.6 billion (2016: R5.9 billion), sponsorships revenue also decreased by 18% to R384 million (2016: R469 million), and TV license revenue also decreased by 7% to R915 million (2016: R986 million) compared to prior year.

The corporation received an adverse audit opinion for the period under review. The factors which contributed to this adverse opinion include amongst others; going concern basis of accounting, property plant and equipment, irregular expenditure and deferred government grants.

Despite all these challenges, the SABC was able to deliver on its on its public service mandate, as set out by the Broadcasting Act No 4 of 1999 as amended, as well the Independent Communications Authority of South Africa (ICASA).

Umhlobo Wenene FM scoops SATMA award

SATMA hosted the 12th edition of the South African Traditional Music Awards. This prestigious event which seeks to ensure that as South Africans we preserve our diverse languages and culture .We saw the entire traditional music fraternity descend upon Mahikeng where the event was held.

SABC is a media partner in these awards; all the SABC African Language radio stations take part in these awards as they are the custodians of our language and culture. There are two widely contested categories within the radio categories, that is the best traditional music radio programme of the year and the best traditional radio presenter of the year.

At this year’s awards an unfortunate situation happened where the best traditional radio presenter was omitted due to technical glitches .Upon investigation by the Station manager Mr Phumzile Mnci and Mr Siphelele Sixaso it was discovered that the category had been forgotten and the winner of the awards as revealed by the auditors was indeed Mr Monwabisi Gudlabatshakazi Bangi of Umhlobo Wenene FM.

On Thursday the 05 October 2017, SATMA Awards founder, Mr Goba  travelled to Umhlobo Wenene FM in  Port Elizabeth to hand over the award to Gudla who emerged as the winner in the best traditional music radio  presenter category.

This follows a public apology made by the SATMA founder Mr Goba on the station’s breakfast show the BEE on Monday the 02nd of October 2017, where he informed listeners about the mishap and promised to personally deliver the award to the station and he fulfilled that promise as he flew down with the camera crew including Mr Siphelele Sixaso, the Head of Marketing Radio in SABC to witness the event. A special honorary Award known as the Lasting Legacy Award was posthumously awarded to the late Saba Mbixane who had won in both categories for a consecutive six years.
“Xa inkosi ibekwa ayibekwa ezizweni, ibekwa kumaxhanti akowayo” this was a positive opening line from Gudla as he accepted the award which means that a king is crowned in his homestead referring to the award being a blessing as he is receiving it at home. It was a joyous moment followed by African cuisine as the SABC staff dressed in their traditional regalia.

Mr Mnci the station manager had this to say, “I wish to congratulate Gudla for ensuring that the legacy left by Saba Mbixane is continuing. It is abundantly clear that the station together with the listeners have made the right decision by choosing him to replace the late Saba Mbixane. Through this achievement the station is continuing its mission to take every award coming its way .A clear demonstration that Umhlobo Wenene FM is the best station in South Africa. We would like to thank our listeners for always being loyal to the station of their choice”
