ANC KZN against Mantashe's statements on appeal

The African National Congress (ANC) leagues in KwaZulu-Natal have rejected a statement by party's Secretary General Gwede Mantashe that the provincial leadership cannot decide on its own to appeal the Pietermaritzburg High Court ruling.

The Women's League, Youth League and some regional leadership addressed a media briefing in Durban to convey their support for the party's Provincial Executive Committee's indication that it will appeal a judgment declaring the 2015 elective conference void.

Youth League Provincial Secretary Thanduxolo Sabelo has accused the NEC of trying to come in at the tail end of the court battle and trying to dictate to the ANC provincial leadership.

“The PEC is appealing the decision and we don't need anybody's permission. We don't even need a permission of the NEC. It is the PEC that is in court. It's not the NEC. It does not make sense. Imagine you are arrested for something, you get convicted, someone else comes and says they want to appeal for you; you must not appeal. In fact, today the officials must file an intention to appeal.”

According to Youth League Provincial Chairperson, Kwazi Mshengu, appealing the judgement does not mean that they fear losing during a re-run of the conference. However, he says the judgment sets the wrong precedent that conferences of the ANC cannot be convened early or late.  

“We argue that this rule does not deny the PEC its right to request the conference before the term of office, if in its wisdom has come to a determination that it is better to go to the conference. What happened if the PEC decides we can no longer lead?"

The provincial Women's League says it is convinced that even if there will be a re-run of the provincial conference, Sihle Zikalala, will still win the election.

“We are more than ready. If it is said the conference must go back, we'll do wonders this time. So, we are not afraid and we are more than ready, even if the conference is called tomorrow,” says Women's League Provincial Chairperson Nonhlanhla Khoza.
The leagues maintain it was wrong in the first place to take the current ANC provincial leadership to court since they did not convene the 2015 conference. They say it was convened by the previous leadership which included former Chairperson Senzo Mchunu and Sihle Zikalala who was provincial Secretary at that time.
